Activity licence for micropropagation of cultivating material

You are required to apply for an activity licence if you wish to propagate cultivating material via micropropagation for forestry purposes. The activity license is issued by the Environmental Board.

The producing of cultivating material via micropropagation is regulated by:

  • Plant Propagation and Plant Variety Rights Act;
  • Regulation of the Minister of the Environment „Requirements for the origin of basic material used to produce forest reproductive material approved for reforestation, and for the delivery and marketing of forest reproductive material“ .

Requirements to the submitter

To be issued an activity license for the micropropagation of cultivating material, you must comply with the following requirements:

  • The laboratory must be equipped with devices necessary for the propagation of cultivating material via micropropagation.
  • The employees of the laboratory must be competent to produce cultivating material via micropropagation.
  • The laboratory must develop, document and implement the methods and procedures to the extent necessary for ensuring product quality.
  • The laboratory must have a self-regulation system.
  • The laboratory must have a valid and implemented procedure of verification of documented origin of the starting material used for the production of cultivating material.
  • The laboratory must keep records of the cultivating material produced via micropropagation and ensure that a maximum of one million ramets may be derived from a single ortet via micropropagation for marketing in Estonia for the purpose of renewing the forest.

Cross-border operation

The supplying of cultivating material is regulated by Council Directive 99/105/EC on the marketing of forest reproductive material. Member States have specified responsible authorities on their territory, who can provide specific information regarding the implementation of the requirements of the aforementioned directive in the respective Member State.

Filling in and submission of a notice

To acquire an activity licence, you must submit a respective application (link) and the following supplementary documents:

  • List of equipment used for the micropropagation of cultivating material.
  • Confirmation of competency of employees of the micropropagation laboratory.
  • Description of the technology used for the micropropagation of cultivating material.
  • Self-regulation system of the micropropagation laboratory.
  • Procedure of verification of the origin of the starting material used in the micropropagation laboratory.

For applying for the activity license, you are required to pay a state fee of EUR 20 to the bank account of the Ministry of Finance with reference number 2900081693.

Processing of an application

The submitted application is processed within 30 days. You will be notified of the issuing of the activity license via e-mail.

The activity licence shall be issued by the Environment Board to the address specified on your application.

If the data specified in the application is incomplete, you shall be contacted after the submission of the application via e-mail or telephone and asked to eliminate the inconsistencies. After the inconsistencies have been eliminated, the activity licence shall be issued within 30 days.

Changing the data of an activity licenc

If you wish to amend the activity licence (for example, adding new tree species into the list of tree species to be micropropagated), you must submit a notice regarding the intention of amending economic activity in the eesti.ee portal / in the electronic environment of the Register of Economic Activities at least 30 days before the planned amendment.

The application for the amendment of the activity license shall be processed by the Environmental Board in accordance with the procedures of issuing an activity license.

If you wish to amend the location of the activity, you must notify the Environment Board within 5 working days after amending the respective data.

Discontinuation of economic activities

If you wish to temporarily suspend the economic activity, you must submit a notice specifying the starting date of the suspension and the date of resumption of economic activities by entering the Register of Economic Activities through the State Portal (use of the service requires login with an ID card, Mobile ID or via an internet bank).

If you wish to terminate the economic activity, you must submit a notice regarding the termination of economic activities by entering the Register of Economic Activities through the State Portal (use of the service requires login with an ID card, Mobile ID or via an internet bank).

Revoking of the activity licence

An activity licence shall be revoked on the basis of the following grounds:

  • Intentional submission of incorrect information by an undertaking upon application for an activity licence, which affected the grant of a licence, provided that, if such information had not been submitted, the grant of an activity licence would have been denied.
  • Renouncement of economic activities by an undertaking.
  • Validity of a relevant prohibition on economic activities imposed by a court judgment or arising from law in a relevant area of activity in respect of an undertaking, except for validity of a prohibition on economic activities imposed pursuant to this Act.

An activity licence may be revoked on the basis of the following grounds:

  • Failure to commence economic activities within two years after issue of the activity licence or failure to pursue economic activities within two years.
  • Material violation of an economic activity requirement in the subject of review of the activity licence or a secondary condition of the activity licence.
  • A significant damage or danger caused to public order by the activity permitted by the activity licence, which did not exist or was not known at the time of grant of the activity licence and which overrides the interest of the undertaking in continuing the activity and which cannot be eliminated by amendment of the activity licence.
  • The arising of a resolutive condition which has been imposed as a secondary condition of the activity licence and which serves as a prerequisite for the validity of the activity licence in the relevant area of activity.

Supervision

The Environmental Board is responsible for the national supervision in the field of cultivating material, including the micropropagation of cultivating material.
