Notice of economic activities for feed business operators


If you wish to commence economic activities as a feed business operator, then you need to submit a notice of economic activities in the following areas of activity prior to commencing economic activities:

  • manufacturing or processing feed material for one’s own undertaking (e.g. manufacturing silage, hay or straw, and growing, cleaning, drying, milling or kneading grains, legume vegetables, tubers, root crops or other crops for feeding animals kept in one’s own undertaking) with the purpose of manufacturing animal products for marketing purposes (i.e. eggs, milk, etc.);
  • processing or manufacturing (e.g. concentration, peeling or dehusking, drying, extraction, pressing, flaking, milling, heat treating, hydrogenation, cold pressing or pressing with heating, granulation, wet milling, etc.) of feed material (plant, animal or mineral) for the purpose of placing on the market, marketing (sale, mediation, import, export), transport and storage;
  • mixing compound feeds without using feed additives or their pre-mixtures for one’s own undertaking (e.g. mixing a compound feeds from complementary feed and feed material or different feed materials for feeding animals kept in one’s own undertaking);
  • mixing, transport or storage of animal proteins or feed containing animal proteins for one’s own undertaking (e.g. transport or storage of fish meal or feed containing it);
  • retail sale of packaged feed (except pet food) (sale of packaged feed for farm animals, including horses and rabbits, in shops);
  • marketing the by-products of food manufacturing to feed business operators for feeding animals (e.g. products remaining from manufacturing pastry, pasta and confectionery products, beer manufacturing by-products, whey, ice-cream manufacturing by-products, etc.);
  • manufacturing compound feed for one’s own undertaking or for the purpose of placing on the market by using approved feed additives (e.g. vitamins A and D, copper and selenium compounds) or their pre-mixtures (e.g. manufacturing a compound feed consisting of two feed materials and a feed additive or pre-mixture with the purpose of feeding it to the animals kept in one’s own undertaking or for sale);
  • manufacturing feed additives (e.g. flavourings) for placing on the market, marketing (sale, mediation, import, export), transport and storage;
  • manufacturing of pre-mixtures from feed additives (e.g. microelement compounds, copper and selenium compounds) for placing on the market, marketing (sale, mediation, import, export), transport and storage.
  • manufacturing pet food for placing on the market, marketing (wholesale, mediation, import export), transport and storage;
  • feeding animals kept for the manufacture of foodstuffs of animal origin for putting into circulation (e.g., an undertaking engages in the manufacturing of eggs or poultry and buys all of the bird feed).

A more detailed list of areas of activity and substances is available in Regulation No. 31 of the Minister of Rural Affairs of 12 June 2014 “The specified list of the areas of activity and the substances used upon handling in the case of which a feed business operator is required to submit a notice of economic activities or is required to have an activity license”, Annex 1.

If you wish to commence economic activities simultaneously on several of the fields of activity specified above, then you can submit all of the relevant information in one notice of economic activities.

A notice of economic activities is not required if you need to have an activity licence before commencing activities in the fields specified above or if you:

  • manufacture feed for your own animals, whose production is used for private domestic consumption only, or that are not used as food;

  • manufacture feed for your own animals, whose production is marketed in small quantities (e.g., eggs from a farm with up to 50 birds or up to 100 kg of raw milk per day) directly to the end consumer;
  • feed animals, whose production is only used for private domestic consumption or is not used as food;
  • marketing small quantities (up to 5 tons per year) of primary production of feed manufactured by you (e.g., grains, hay, silage, etc.) directly to the end consumer;
  • retail pet food.

Operating in the area of handling feed is regulated by the following legislation:

  • Feed Act;
  • General Part of the Economic Activities Code Act;
  • Regulation (EC) No. 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law;
  • Regulation (EC) No. 183/2005 of the European Parliament and of the Council;
  • Commission Regulation (EU) No. 68/2013 on the Catalogue of feed materials;
  • Regulation (EC) No. 767/2009 of the European Parliament and of the Council on the placing on the market and use of feed;
  • Regulation (EC) No. 1831/2003 of the European Parliament and of the Council on additives for use in animal nutrition;
  • Regulation (EC) No. 999/2001 of the European Parliament and of the Council on the rules for the prevention, control and eradication of certain transmissible spongiform encephalopathies.

Cross-border operation

If an undertaking has been established and operates as a feed business operator subject to a notice of economic activity in another Contracting State of the European Economic Area, and wishes to start permanent operations in the same area of activity in Estonia, then the undertaking must submit a notice of economic activity before commencing economic activities in Estonia.

Completing and submitting an application

You can submit the notice of economic activities:

  • via the client portal of the Ministry of Rural Affairs (the portal can be entered with and ID-card or mobile ID);
  • digitally signed by e-mail to feed@vet.agri.ee;
  • by regular mail to the Office of Feeds of the Veterinary and Food Board at Väike-Paala 3, 11415 Tallinn;
  • by delivering it to the VFB (Väike-Paala 3, 11415 Tallinn) or its local institution;
  • through a notary.

The form of the notice of economic activities is available on the website of the Veterinary and Food Board. The undertakings who submit an electronic notice fill in their notice directly in the information system and do not have to prepare a separate PDF or paper document.

NB! By providing an e-mail address on the application form for a notice of economic activities, the feed business operator consents to having the administrative act delivered electronically.

Amending the information on a notice of economic activities

The Veterinary and Food Board must be notified of any changes to the data on a notice of economic activities immediately, but no later than within 5 working days.

You can notify the Veterinary and Food Board of the changes:

  • via the client portal of the Ministry of Rural Affairs (ID-card or mobile ID required);
  • digitally signed by e-mail at feed@vet.agri.ee;
  • by regular mail to the Office of Feeds of the Veterinary and Food Board at Väike-Paala 3, 11415 Tallinn;
  • by delivering it to the VFB (Väike-Paala 3, 11415 Tallinn) or its local institution;
  • through a notary.

The form for a notice of changes is available on the website of the Veterinary and Food Board. The undertakings who submit an electronic application fill in their notice directly in the information system and do not have to prepare a separate PDF or paper document.

Termination of economic activity

If you wish to renounce or terminate the handling of feed, then you need to submit a notice on the termination or temporary renouncement of economic activities to the Veterinary and Food Board.

In case of termination of the handling of feed, the notice must state the date of termination of economic activities. If the handling of feed is temporarily renounced, then the handler can state the date of renouncement and re-commencement of economic activities.

You can submit a notice on the termination or temporary renouncement of economic activities:

  • via the client portal of the Ministry of Rural Affairs (the portal can be entered with and ID-card or Mobile-ID);
  • digitally signed by e-mail to feed@vet.agri.ee;
  • by regular mail to the Office of Feeds of the Veterinary and Food Board at Väike-Paala 3, 11415 Tallinn;
  • by delivering it to the VFB (Väike-Paala 3, 11415 Tallinn) or its local institution;
  • through a notary.

The form of a notice of termination or temporary renouncement of economic activities is available on the website of the Veterinary and Food Board. The undertakings who submit an electronic notice fill in their notice directly in the information system and do not have to prepare a separate PDF or paper document.

Supervision

The Veterinary and Food Board exercises governmental control over the conformity of the handling and use of feed.

A feed business operator shall pay a state fee of 195 euros for exercising official control, including supervisory activities for every undertaking, which engages in the activity of feed handling. State fee shall not be paid for an undertaking, which engages in the sale of packaged feed in retail business.
