Notice of economic activities for the plant health register


An operator, who wishes to commence economic activities as an importer, manufacturer or exporter of plants and plant products, must submit a respective notice of economic activities to the plant health department of the Agricultural Board.

Notification obligation applies to operators, who:

  • manufacture, store, package or market bulbs and corms; planting and propagating material of fruit trees, vegetables, berries and ornamental plants; seed potatoes and potatoes for consumption; mangold and sugar beet plants; citrus fruits with leaves and peduncles; the raw wood and bark of chestnut and plane trees; the cultivation material of forest trees;
  • exports plants and plant products subject to phytosanitary inspection from Estonia to a state outside the EU;
  • processes undried softwood for export to EU member states;
  • applies for declaring a dry kiln to be in conformity with the requirements or for the right to use a conformity mark;
  • imports plants and plant products subject to phytosanitary inspection from a state outside the EU to Estonia;
  • packages seeds (seeds of cereal grains, fodder crop, oil or fibre plants; seeds of beet or market-garden crop; small packaging of vegetable, fodder crop or beet seeds; seed blends of cereal grain, fodder crop, oil or fibre plants or market-garden crop).

The notification obligation does not apply to an operator, who:

  • markets plants, plant products or other objects produced by it, except potatoes and plants, plant products and other objects equipped with a plant passport, only to a person entered in the plant health register;
  • markets plants, plant products or other objects produced by it, except potatoes and plants, plant products and other objects equipped with a plant passport only by way of retail trade directly to the end consumer in the territory of the Republic of Estonia;
  • uses plants, plant products or other objects produced by it for its own purposes;
  • grows potatoes in an area of up to one hectare for a purpose other than marketing;
  • markets plants and plant products received from a person entered in the plant health register, except potatoes and plants and plant products equipped with a plant passport, by way of retail trade directly to the end consumer in the territory of the Republic of Estonia;
  • engages in the propagation, production, conservation, processing, marketing or importing of seed or propagating or cultivating material, and has the notification obligation under the Plant Propagation and Variety Rights Act.

Activity in the field of plant health is regulated by the following legislation:

  • Plant Protection Act;
  • General Part of the Economic Activities Code Act;
  • Plant Propagation and Plant Variety Rights Act;
  • Regulation No. 102 of the Government of the Republic “The constitutive regulations of the plant health register”;
  • Regulation No. 96 of the Minister of Agriculture “The list of plants, plant products and other objects which are inspected at the place of production and with regard to which plant passports are issued, the list of information to be entered on a plant passport and the procedure for issuing and replacing plant passports”;
  • Regulation No. 97 of the Minister of Agriculture “The list of plants, plant products and other objects for which phytosanitary certificates are issued and which must undergo a phytosanitary inspection at the border inspection post;
  • Regulation No. 112 of the Minister of Agriculture “The procedure for inspecting plants, plant products and other objects upon their conveyance from third countries to Estonia”;

Completing and submitting a notice

You can submit a notice of economic activities:

The form of the notice of economic activities is available on the website of the Agricultural Board. The operators who submit an electronic notice fill in their notice directly in the information system and do not have to prepare a paper document.

Payment of state fee

A state fee of 32 euros is applied for an entry into the plant health register.

A state fee of 10 euros is paid for the submission of a notice of economic activities by any means other than via the client portal of the Ministry of Rural Affairs. The state fee must be paid before the submission of the notice.

The state fee is to be paid to a bank account of the Ministry of Finance with reference number 2900082207:

No state fee is applied for the submission of a notice of amendment of data on the notice of economic activities or renouncement of economic activities.

Amendments to the data on the notice of economic activities

In case of a change of the field of activity, the operator must submit a notice for the amendment of general information in the plant health register to the plant health department of the Agricultural Board immediately, but no later than within five working days, stating the information that needs to be added or removed.

Renouncement of economic activities

In case of renouncement of activities entered into the plant health register, the operator must submit a notice of renouncement of economic activities entered in the plant health register to the plant health department of the Agricultural Board.

In case of temporary renouncement of activities entered into the plant health register, the operator must submit a notice of temporary renouncement of economic activities entered in the plant health register to the plant health department of the Agricultural Board, stating the dates of renouncement and re-commencement of economic activities.

Supervision

The chief specialists of the plant health department of the Agricultural Board and the plant health inspectors of the county centres of the Agricultural Board exercise governmental supervision over the handling of plants and plant products
