Notice of economic activity for provision of pest control

A person engaging in pest control must be an undertaking within the meaning of the Commercial Code to be able to provide pest control services.

An undertaking organising pest control shall register itself in the Register of Economic Activities.

The obligation of registering an undertaking organising pest control arises pursuant to the following legislation:

Requirements for an applicant

A person may engage in pest control if the person has a corresponding registration in the Register of Economic Activities (hereinafter REA) and has a corresponding legal relationship with a specialist in charge or if the sole proprietor is itself competent to act as a specialist in charge or is employed with an employer and holds a certificate of professional qualifications acquired within the meaning of the Biocides Act.

A specialist in charge is a person who is competent to direct and organise pest control and consult undertakings. In order to direct and organise pest control, a specialist in charge shall hold a professional qualification within the meaning of the Professions Act (pest controller class III), which grants such a person the right to organise the distribution of funds and the work of other persons and imposes on the person the obligation to be responsible for such work.

Cross-border operation

If an undertaking has been established in another contracting state of the European Economic Area but also wishes to provide continuous services in Estonia, the undertaking must apply for the recognition of a foreign qualification at Ministry of Social Affairs.

Undertakings of a contracting state of the European Economic Area which provide temporary communications service are exempt from the obligation of submitting the notice of economic activity, unless a special law does not stipulate the obligation of submitting the notice of economic activity.

Professional qualification of employees

If you wish to employ an employee, who has received his/her qualification abroad or has professional (vocational) work experience abroad, the employee must have his/her professional qualification recognised in Estonia. A professional qualification acquired abroad may not automatically comply with the conditions established in Estonia.

Payment of the state fee

A state fee in the amount of EUR 10 shall be paid for submitting the notice in other manner than via the State Portal. The state fee shall be paid prior to the submission of the notice.

The state fee can be paid by bank transfer to the account of the Ministry of Finance with the reference number 2900073083:

State fee in the amount of EUR 10 shall be paid for the changing of notice of economic activity if the changes are submitted in other manner than via the State Portal. No state fee shall be paid for renouncement of economic activity.

Changes in the information of a notice of economic activity

Upon a change in the information of a notice of economic activity, an undertaking notifies the registrar thereof promptly, but no later than within five working days, specifying the changed information in the notice.

Confirmation of the information of a notice of economic activity

As an undertaking, you are required to confirm your information in the Register of the Economic Activities once a year by annual report or income tax return.

Prior to confirmation, you have to check correctness of the information, and in case of changes in the information, you have to bring the information into conformity with the reality.

Supervision

The following institutions shall exercise state supervision over the compliance with the requirements set out in the Biocides Act:

  • Labour Inspectorate – over occupational health and safety requirements.
  • Environmental Inspectorate – over activities damaging or dangerous to the environment.
  • Consumer Protection Board – over compliance with the requirements for the retail sale of biocides.
  • Veterinary and Food Board – over fields regulated by the Food Act and the Veterinary Activities Organisation Act.
  • Health Board – over compliance with marketing and safety requirements in wholesale trade, the processing of drinking and bathing water, the provision services and other fields regulated by the Public Health Act, also the compliance of safety requirements on the part of persons providing health care services in fields regulated by the Health Services Organisation Act.
  • Tax and Customs Board – over inspecting the validity of the product authorisation and certificate of registration of biocides upon importing biocides to the customs territory of the Community.
