Operating permit for organising gambling

The activity of a gambling operator is regulated by the:

Requirements for applicants

An operating permit can only be issued to holders of an activity licence for organising gambling, except in cases specified in § 22 (2) of the Gambling Act.

Cross-border operation

Harmonised requirements are not in effect with regard to organising gambling in the European Union. This means that an activity licence obtained in another country of the Agreement on the European Economic Area does not entitle you to provide gambling services in Estonia or to apply for an operating permit here and vice versa.

Filling and submission of an application

If you would like to obtain a an operating permit for opening of a gaming location or for organising a toto, lottery or additional game of chance, please submit an application and include to it the following additional documents.

The following must be enclosed to an application for an operating permit for a game of chance, toto or game of skill:

  • written consent of a rural municipality government or city government for opening a gaming location for a game of chance, toto or game of skill at an address indicated on the application, except for a gaming location on a ship that is entered in the Estonian register of ships and carries out passenger transport;
  • plan and description of the gaming location;
  • information about the gaming equipment used for organising gambling;
  • the rules of the game;
  • an overview of the security measures to be applied in the gaming location and upon organising the game;
  • information on how the protection of the data of the persons participating in the game will be secured in accordance with the Personal Data Protection Act.

If bets for toto are accepted or if prizes are distributed by means of distance communication, then additionally one must add the telephone numbers, website addresses and other contact details enabling the making and accepting of bets, and information on the current accounts used for intermediation of payments between the operator and players.

The following shall be appended to the application for a lottery operating permit:

  • the rules of the game;
  • information on how the protection of the data of the persons participating in the game will be secured in accordance with the Personal Data Protection Act.

If bets for passive lottery are accepted or if prizes are distributed by means of distance communication, then additionally one must add the telephone numbers, website addresses and other contact details enabling the making and accepting of bets, and information on the current accounts used for intermediation of payments between the operator and players.

In the case of instant lottery, a design of the lottery ticket must also be enclosed together with a description of the security features of the lottery tickets.

When applying for an operating permit for an additional game of chance, the rules of the additional game of chance must be added to the application.

Remote gambling

If you would like to obtain a an operating permit for organising gambling as remote gambling (online casino), please submit an application and include to it the following additional documents:

  • information about the gaming equipment used for organising gambling;
  • the rules of the game;
  • an overview of the security measures to be applied in the gaming location and upon organising the game;
  • information on how the protection of the data of the persons participating in the game will be secured in accordance with the Personal Data Protection Act;
  • information regarding the software used for organising remote gambling;
  • independent expert assessment on the compliance of the software used for organising remote gambling with the requirements provided for in § 54 of the Gambling Act;
  • telephone numbers, website addresses and other contact details enabling to participate in gambling;
  • information on the current accounts used for intermediation of payments between the operator and players.

You can submit an application in the following ways:

Payment of the state fee

A state fee is payable for reviewing an application for an operating permit for organising gambling (except lottery) in the amount of 3200 euros.

A state fee is payable for reviewing an application for an operating permit for organising lottery in the amount of 640 euros.

The state fees payable for reviewing applications for an operating permit for organising gambling can be paid via bank transfer to the following bank accounts of the Ministry of Finance:

The reference number to be indicated on the bank transfer is 2900082919.

Processing the application

You will receive an initial reply from the Estonian Tax and Customs Board on the 3rd working day after the date of submission of your application.

The Estonian Tax and Customs Board will make a decision to issue an operating permit or refuse to issue an operating permit within two months after receipt of all the necessary documents and information but not later than within 4 months after receipt of an application for the operating permit.

You will be notified of the issuance of an operating permit via email.

The operating permit is issued electronically.

The operating permit is issued for up to a 20-year term.

Changes to operating permit conditions

The Estonian Tax and Customs Board should be notified of any changes in the information provided on the application for an operating permit at the first opportunity but not later than within 5 working days.

Information concerning the changes must be submitted as follows:

Revocation of operating permit

An operating permit is revoked if it is found that you have deliberately submitted false information during the application process for the operating permit and such information impacted the issuance of the permit and in case such information had not been submitted the operating permit should have been refused or if you renounce economic activities.

A company is also deemed to have renounced economic activities if they fail to submit the mandatory annual confirmation regarding the fact that they have notified the Estonian Tax and Customs Board concerning any changes to the operating permit conditions.

An activity licence may also be revoked on grounds specified in § 30 of the Gambling Act.

Supervision

State supervision over the organisation of gambling is exercised by the Estonian Tax and Customs Board.

State supervision in the field of consumer rights and advertising is handled by the Consumer Protection Board.

State supervision in the field of money laundering and terrorist financing prevention is handled by the Financial Intelligence Unit.
