Provision of occupational hygiene, ergonomics and psychology services

If you wish to commence economic activities in the field of occupational hygiene, ergonomics and/or psychology, then you need to notify the Health Board of the commencement of economic activities. A notice of economic activities must be submitted before starting with economic activities.

The duties of an occupational hygienist are as follows:

  • determining working environment hazards;
  • advising employers on the improvement of working conditions.

The duties of an ergonomist are as follows:

  • determining the physiological and psychological working environment hazards;
  • advising employers on the ergonomic design of workplaces and on adapting the work to the employee;
  • advising employers on the choice of work equipment and its safe use.

The duties of an occupational psychologist are as follows:

  • psychological counselling of employers, including counselling on how to reduce work-related stress.

Your activity as a provider of occupational hygiene, ergonomics and psychology services is regulated by the following legislation:

Requirements for the applicant

You must comply with the following requirements to provide services in your chosen field of activity:

  • the person directly providing the service must hold a diploma certifying his or her professional competence as an occupational health specialist, or a certificate of specialisation or in-service training.
  • if you wish to provide the service of determining working environment hazards as part of risk analysis, including the measurement of the parameters of working environment hazards and an evaluation of their possible effect on the health of employees, you must additionally verify your competence as a legal person for the purposes of the Metrology Act.

There are two ways to do that:

  • you hold a certificate issued by the Estonian Accreditation Centre verifying that you are a competent measurer for the purposes of the Measuring Act;
  • you have a bilaterally signed agreement with an establishment accredited by the Estonian Accreditation Centre for measuring the parameters of working environment hazards. A list of accredited establishments is available on the website of the Estonian Accreditation Centre.

Cross-border activity

A notice of economic activities for the provision of occupational hygiene, ergonomics and/or psychology services grants the right to provide permanent services only in the Republic of Estonia. If you wish to provide the service outside Estonia, then you need to apply for the rights of service provision from the competent authority of the destination country.

For the permanent provision of occupational hygiene, ergonomics and/or psychology services in the Republic of Estonia, you need to submit a notice of economic activities in Estonia.

If you wish to temporarily provide services you are providing based on an Estonian notice of economic activities also in other EU member states, or you wish to provide registered services in Estonia based on a licence acquired in another member state, then you have such a right based on Directive 2006/123/EC of 12 December 2006 on services in the internal market.

Completing and submitting a notice

A notice of economic activities must contain the following information:

  • in the case of legal proprietor, the name and registry code, and in the absence thereof the relevant identification code of the country of its seat (the numerical or letter combination equal to the registration number); in the case of a sole proprietor, the name and registry code, and in the absence thereof the personal identification code or date of birth and the name and number of the identity document;
  • contact details (telephone number, e-mail address and postal address) of the undertaking;
  • in the case of an undertaking of another Contracting State or a third country, the address of its seat, if it differs from the postal address;
  • the name of the area of activity pursuant to law and the name and the EMTAK code in accordance with the classification established pursuant to subsection 4 (6) of the Commercial Code;
  • the date of commencement of economic activities in the relevant area of activity, if it differs from the date of submission of the notice of economic activities;
  • the date of termination of economic activities, if the economic activities are planned for a specified term;
  • the name and contact details (telephone number and e-mail) of the person signing the notice, and in the case of a legal person also the basis for representation (member of the management board or authorisation);
  • service(s) of occupational safety to be provided;
  • name(s) of the occupational health specialist(s);
  • contact details of the occupational health specialists (telephone number, e-mail address);
  • information concerning the occupational health specialist’s/specialists’ diploma certifying his or her/their professional competence or concerning his or her/their certificate of specialisation or in-service training, above all the speciality, certificate number, place and date of issue as well as period of validity thereof;
  • a legal person’s or a sole proprietor’s written statement that the occupational health specialist(s) is/are working for the legal person or sole proprietor under a contract;
  • if you wish to provide the service, specified in clause 2 (3) 1) of Minister of Social Affairs’ Regulation No. 89 of 20 June 2003, which is the service of determining working environment hazards as part of risk analysis, including the measurement of the parameters of working environment hazards and an evaluation of their possible effect on the health of employees, then you must additionally verify your competence as a legal person for the purposes of the Metrology Act.

You can submit a notice of economic activities as follows:

  • by entering the register of economic activities through the state portal (you need to log in with an ID card, Mobile-ID or via the internet bank). In the register, please select “Submit a notice of economic activities”. As the next step, you need to select the area of activity that your message is concerning – occupational safety is a sub-item of social welfare in the menu.

Changes in the information of a notice of economic activity

If you wish to renew the information on your notice of eeconomic activity, you can do that by entering the register of economic activities through the state portal (you need to log in with an ID card, Mobile-ID or via the internet bank).

Renouncement of economic activities

If you wish to renounce economic activities, then please submit a relevant notice to the Ministry of Economic Affairs and Communications, specifying the time of renouncement of economic activities. You can do that by entering the register of economic activities through the State Portal and inserting the date of renouncement of economic activities.

If you renounce economic activities for a specified term, then you may give notice of the date of renouncement as well as re-commencement of economic activities.

Supervision

The Health Board exercises governmental control over the providers of occupational health services and their economic activities in accordance with the conditions and procedure set forth in the Health Services Organisation Act.
