Notice of economic activities for operating as a job mediator

Job mediation means finding suitable work for job seekers, and finding suitable employees for employers.

If you wish to start activity as a job mediator, then you need to submit a notice of economic activities prior to commencement of economic activities. You can do that via the Estonian information portal eesti.ee or through a notary.

Job mediation activities are regulated by the following legislation:

Requirements for the applicant

The following requirement applies for the provision of job mediation:** it is prohibited for a job mediator to charge a fee for information concerning free positions and employers from a person wishing to find employment** (section 391 of the Labour Market Services and Benefits Act).

Job mediation is a collection of services with a prohibition on charging fees extended to its every aspect. Therefore, it is forbidden to charge a fee, for example, for publishing information about free positions and for notifying about living and working conditions.

An undertaking may charge a fee for job mediation only from an employer or other undertakings.

Cross-border activity

If an undertaking is established and provides job mediation in another Contracting State of the European Economic Area, but also wishes to operate in Estonia, then the undertaking is subject to the requirements provided by the Commercial Code of the Republic of Estonia.

With permanent provision of job mediation, the foreign undertaking must register a branch in the Estonian business register and submit a notice of economic activities to the register of economic activities. A notice of economic activities is not necessary for undertakings of the Contracting States of the European Economic Area who provide the service in Estonia on a temporary basis.

Completing and submitting a notice

A notice of economic activities must contain the following information:

  • in the case of an undertaking which is a legal person the name and registry code, in the absence thereof, the relevant identification code of the country of its seat (the numerical or letter combination equal to the registration number);
  • in the case of a sole proprietor, the name and registry code, in the absence thereof, the personal identification code or date of birth and the name and number of the identity document;
  • contact details (telephone number, e-mail address and postal address) of the undertaking;
  • in the case of an undertaking of another Contracting State or a third country, the address of its seat if it differs from the postal address;
  • the name of the area of activity pursuant to law (job mediation) and the classification name and code (Activities of employment placement agencies, classification code 78101);
  • the date of commencement of economic activities as a job mediator if it differs from the date of submission of the notice of economic activities;
  • the date of termination of economic activities if the economic activities are planned for a specified term;
  • the name and contact details (telephone number and e-mail) of the person signing the notice, in the case of a legal person also the basis for representation (member of the management board or authorisation).

If you submit a notice of economic activities through a notary, the notary forwards the notice to the register of economic activities through the Estonian information portal within the working day following its submission at the latest. The Ministry of Economic Affairs and Communications sends documents and other information to you through the notary if you have expressed such wish upon submission through notary of a notice.

A notary fee is applied when submitting a notice through a notary. No state fee is applied when submitting a notice of economic activities through the State Portal.

Amending the data on a notice of economic activities

The register of economic activities must be notified of any changes to the general information of a notice of economic activities immediately, but no later than within 5 working days, stating the changed information in the notice.

If you submit a notice on change in the general information concerning economic activities through a notary, the notary forwards the notice to the register of economic activities through the Estonian information portal within the working day following its submission at the latest. The Ministry of Economic Affairs and Communications sends documents and other information to you through the notary if you have so requested upon submission through notary of a notice.

Renouncement of economic activities

In case of renouncement of economic activities, please submit a notice on renouncement of economic activities to the register of economic activities, stating the date of termination of economic activities.

In case of temporary renouncement of economic activities, please notify the register of economic activities of the dates of renouncement and re-commencement of economic activities.

Supervision

The Ministry of Social Affairs exercised governmental administrative supervision over the compliance of undertakings providing job mediation services and their economic activity.
