In order to operate as a seller of electricity, an undertaking must present a notice of economic activity to the registrar of economic activities.
The obligation to notify does not apply in the following cases:
- when selling electricity in accordance with clause 1 or 2 of subsection 6 of section 15 of the Electricity Market Act;
- when selling electricity generated by the producer;
- when selling electricity on the power exchange;
- when selling electricity in accordance with subsection 3 of section 16 of the Electricity Market Act;
- when selling electricity, provided the distribution network operator only provides, to the market participant, the service of open supply in accordance with subsection 4'1 of section 44, or universal service in accordance with section 76'1 of the Electricity Market Act;
- when selling electricity, provided the electricity has been conveyed to the consumer via a direct line and generated by generating installations which have a total net capacity of less than 1 MW.

Cross-border operation
If an undertaking is established and is operating in the area of energetics in another contracting state of the European Economic Area, but wishes to operate permanently in Estonia, then the undertaking is required to submit a notice of economic activities to the Register of Economic Activities.
The notice of economic activities shall not be submitted by an undertaking of a contracting state of the European Economic Area who operates in Estonia in the area of energetics temporarily.
Requirements to the submitter
- the share capital of the electricity seller shall be at least 31,950 euros.
Requirements for notice
A notice of economic activities shall contain at least the following information:
- business name and registry code of the undertaking, in the absence thereof the relevant identification code of the country of its seat (the numerical or letter combination equal to the registration number);
- contact details (telephone number, e-mail address and postal address) of the undertaking;
- in the case of an undertaking of another Contracting State or a third country, the address of its seat if it differs from the postal address;
- the date of commencement of economic activities in the relevant area of activity if it differs from the date of submission of the notice of economic activities;
- the name and contact details (telephone number and e-mail) of the person signing the notice, in the case of a legal person also the basis for representation (member of the management board or authorization).
Payment of the state fee
No state fees apply if a notice of economic activities is submitted via the State Portal. A state fee of 10 euros must be paid in advance to the bank account of the Ministry of Finance if a notice of economic activities is submitted by other means, using the reference number** 2900082935**.

Submitting the notice
A notice of economic activities can be submitted:
- by entering the Register of Economic Activities (authentication is required);
- by sending the digitally signed application to the e-mail address [email protected];
- by sending the application via mail to the address of the Competition Authority: Tatari 39, Tallinn 10134.
Supervision
State supervision is performed by the Estonian Competition Authority.
