Registration of divorce
Registration of divorce
After 1-3 months from the filing of the application for divorce, the spouses must go together at the agreed time to the vital statistics officer of the local government of the county center or to the notary in order to dissolve the marriage. You have to take with you a valid identity document.
If both spouses confirm at this meeting with the signatures that they have not changed their mind and are sure that they wish to divorce, the vital statistics officer or the notary enters the divorce data to the population register and issues to spouses certificates of divorce.
Only if one of the spouses cannot go to the vital statistics officer or notary for a valid reason for the divorce, he or she may exceptionally submit a notarized or certified consent of the Estonian consular officer for the divorce without his or her presence.
Important to know concerning this step
If you did not apply for identity documents with a new surname when submitting the divorce application, you must apply for new identity documents (ID card, passport) within 30 days. You can submit the application in the self-service of the police and border guard board or on site in the service hall. You can find information about the state fee for issuing documents on the website of the police and border guard board. You can find more information about requesting identity documents in the document exchange service.
After receiving the identity documents with the new name, you can also apply for a name change on your driver’s license, vehicle-related documents and at the bank. Be sure to inform your employer, billers, family doctor, etc. If necessary, the name change must also be notified to the business register, land register and subsidy payers, for example the agricultural registers and information board. Most public service providers, such as the social insurance board and the estonian health insurance fund, receive their data from the population register, and there is no need to inform them of the name change.
When divorcing in a local government of the county center or at a notary, both divorced spouses are given a divorce certificate. The certificate is in Estonian and free of charge. When filing for divorce, both spouses can choose whether they want a certificate on paper or electronically.
For submission to a foreign country it is possible to request a duplicate certificate of divorce for a separate state fee also in English, in German and in French. An application can be submitted to any local government of the county center or the Estonian foreign mission on site or in the e-population register.
If the marriage is divorced in court, no certificate is issued, and the document certifying the divorce is the court order. Since the details of the divorce that took place in the court are also entered in the population register, the termination of the marriage can be proved by an extract from the population register, to which the data of the ex-spouse is added. A request for an extract from the population register can also be submitted to any local government of the county center or to the foreign mission of Estonia on site or in the e-population register.
In case you have lost your divorce certificate or you need it in a foreign language (English, German or French) for submission to a foreign country, you can order a new duplicate certificate in the e-Population Register or by submitting an application to the local government of the county center or to the Estonian foreign mission.
How much does the new certificate cost?
A state fee must be paid for issuing the certificate. The amount of the state fee for the certificate issued by the local government is 20 euros, the state fee for the certificate issued by the foreign mission of Estonia is 30 euros. For more detailed information, please contact the local government of the county center that suits you or the foreign representative office of Estonia.
