Check if your company may be required to register in PROTO
Tyres
Important to know concerning this step
Based on this category, a company is generally required to register in PROTO if all three conditions are met:
- the product is a tyre;
- the company places the tyre on the Estonian market;
- the obligation is not fulfilled by an Estonian supplier or a PRO.
If all three conditions are met, join an appropriate PRO. The PRO will submit the PROTO registration application on behalf of the producer. If necessary, read about the next steps in the section on fulfilling obligations.
If it is unclear whether a product belongs to this category or whether the obligation has already been fulfilled, request confirmation from your supplier or the Environment Agency.
This category includes, for example:
- passenger car tyres;
- van and truck tyres;
- bus tyres;
- motorcycle and moped tyres;
- trailer tyres;
- special purpose vehicle tyres;
- agricultural and industrial machinery tyres;
- used tyres placed on the Estonian market.
A tyre can reach the Estonian market as a standalone product or together with a vehicle. If the company brings a vehicle to Estonia with tyres and a battery, check also the categories "Motor vehicles and their parts" and "Batteries and accumulators".
A company places tyres on the Estonian market, for example, when they make it available on the Estonian market for the first time:
- manufactures tyres in Estonia;
- brings them to Estonia from another European Union country;
- orders the product from outside the European Union and sells it to an Estonian customer;
- sells them to Estonian customers;
- leases them out in Estonia;
- sells them to Estonian customers via an online store or other means of distance communication;
- uses tyres ordered from abroad to provide its service;
- brings motor vehicles to Estonia that have tyres fitted or included;
- sells them under its own name or trademark – it may bear producer responsibility even if it does not manufacture the product itself.
The obligation does not depend on the quantity. The determining factor is whether the product is placed on the Estonian market.
Based on this category, a company does not have an obligation to register in PROTO if it purchases tyres from an Estonian supplier who has already placed them on the Estonian market and fulfilled the producer responsibility obligation. Check with the supplier:
- whether the supplier has placed the tyres on the Estonian market;
- whether the producer responsibility obligation has been fulfilled;
- whether the tyres are covered through a PRO;
- whether this also applies to used tyres or tyres that came with a vehicle.
Depending on the situation, the supplier may also bear the obligation. In such cases, it must be determined who first placed the product on the market in Estonia – that party must comply with the requirements.
No, the scope of producer responsibility for tyres is broader. In addition to motor vehicle tyres specified in point 40 of the Traffic Act, it also applies to tyres for trailers defined in § 2 point 9, off-road vehicles defined in point 36, towed equipment defined in point 58, and interchangeable towed machinery defined in point 91 of the Traffic Act.
No, to organize the collection and recovery or disposal of waste generated from tyres, producers are required to conclude a written contract with a producer responsibility organisation.
