Using EMAS and keeping your registration
Suspension and deletion of registration
An EMAS registration is only valid if the organisation complies with the requirements of the Regulation and submits the necessary documents in a timely manner. An EMAS registration may be suspended or removed from the register if it fails to comply with the requirements set out in the EMAS Regulation, fails to submit the required documents on time or infringes environmental legislation. Before taking a final decision, the competent authority will give the organisation the opportunity to remedy the deficiencies, and the registration will be reinstated once compliance has been re-established.
Important to know concerning this step
An EMAS registration may be suspended or deleted if:
- the organisation does not comply with the EMAS Regulation,
- the verifier has not performed his or her duties,
- the organisation fails to submit the required documents within 2 months of receipt of the request,
- there has been a breach of environmental legislation.
Once the registration has been suspended, the organisation can reinstate it after all deficiencies have been rectified and the required documents have been resubmitted. To do this, you need to contact both the accredited verifier and the Environment Agency to agree on the necessary activities and schedule. The registration will be reinstated once the competent authority is satisfied that the organisation is again compliant with all EMAS requirements.
